Auctions can attract tall types of sellers (individuals, companies, estate agents (realtors), local authorities, public bodies, associations executors, etc.) who require speed, security and transparency while at the same time obtaining the market price.
Any property owner can choose to sell by public auction.
It is a method of selling that is particularly convenient :
sellers who want lots of advertising on the sale of their property ;
sellers who require a selling price that the taxation authorities will not dispute ;
sellers who want to sell a special or unusual property which is hard to dispose of.
An auction is the perfect solution for people looking for a selling method that enables a family dispute to be settled, concerning the division of property after inheritance or to decide between buyers with total impartiality.
An auction is the appropriate answer for anyone who wants to get a fair market price for the property, but needs the transparency of a public sale :
local authorities who want to sell some of their assets;
public bodies ;
associations who put properties up for sale that were acquired through bequests;
genealogists-executors in their capacity as representatives of inheritors.
An auction can also be held at the initiative of third parties legally vested with the right to undertake the sale and who require quality, security and transparency in their real estate transaction. Examples are sales of real property in an estate without a claimant, sales of properties belonging to minors or adults who are wards of court or have guardians, and real property in an estate that has no other disposable assets, etc.
The courts can, moreover, order a property to be sold at auction organized by notaries, and order the sale of property by auction of one lot held indivisum (sale of property in indivisum), sales of an attached estate by auction and the sale of real property as part of collective proceedings (class action).
Irrespective of the sellers, all the conditions of the sale are established prior to the sale itself. Each sale is the responsibility of the sellers' notary who draws up the specification sheet in accordance with the regulations specific to this method of selling.
Important to note
Any owner may auction any type of real estate property.
Notaries' auctions should not be confused with forced sales by order of the court.
